Divorce
Child Custody and Visitation
Right now, under Nevada law, a grandparent has some visitation rights if the grandchild’s parents are divorced, or if one of them is dead. If a parent under these circumstances unreasonably restricts visitation by the grandparent, the courts can intervene.
Premarital Agreement
Enough Sam. For now. Those about to be married might consider a pre-marital agreement. Nevada has adopted the Uniform Premarital Agreement Act. See NRS Chapter 123A.
Guardianship
We also aren’t much of a fan of financial powers of attorneys. They often cause more trouble (and legal fees) than they are worth. Most of the time a guardianship of the estate is a better alternative. At least then the party alleged to be incompetent is guaranteed the right to appear before a judge before being stripped of his or her property.
Spousal Support
There are many other items that can be included in a pre-nup to structure the post-divorce situation. Even though the court reserves the right to ensure that the children are supported and cared for (regardless of what the pre-nup says), it does not hurt at all for the parties to set forth their expectations in a pre-nup. For example, during the minority of the children, can the custodial parent move to a distant city? The divorce court, while not bound, would probably be more likely defer to the parties expectations regarding such matters if it knew what the parties had agreed to before they decided to divorce. Likewise the parties can set forth their expectations regarding alimony in the pre-nup. For example, if one of the parties is expected to put the other through school, the pre-nup could provide that in that event, the spouse who worked to put the other through school would have sums set aside for his or her own schooling. However, the divorce/probate court is not bound to enforce the parties’ contract concerning child custody, support and alimony.

Sex Crimes
There are many consent to sex forms on the internet, most better than the one we supply. Be warned that there is no magic form which will protect you. We sense that a detailed form, such as most of those on the internet, may be difficult to use in the heat of the moment. So, while our form won’t protect you from a later charge of rape or something similar, it will at least give you something to argue about. It is very simple and if carried around in your wallet can sometimes be used without breaking the mood.

Estate Planning
Whatever we do in our estate planning whether choosing to execute a will, living trust, deed upon death, or joint tenancy deed, etc, our heirs are likely to find themselves in probate court.
Wills
People have been dying for quite a while. When contemplating making your last will and testament, take a look at Montaigne. He wrote in the mid to late 1500s, in French, but there are many English translations of his work. To give you the flavor of Montaigne, we here quote one paragraph from the 1925 Harvard University press translation by George B. Ives (Book I, Chapter XX)...
Trusts
Cautionary Note. A Nevada probate court will often review transfers at less than market value to beneficiaries via a living trust, will, deed upon death and the like to make sure the transfer was not the product of some kind of funny business, such as fraud, undue influence or the like. If the transfer, other than to a spouse, is to a caregiver, or to a person who drafted or assisted in the drafting of the transfer document, or a relative of such person, there is a presumption that the transfer is void. Sometimes, having the transfer document reviewed by an independent attorney will save it. See the forms under Health, below.
Power of Attorney
But how does the hospital get consent to operate? Certainly not from the patient as he is incapable of giving consent and were he not incapable, would likely not consent to incurring needless pain just so he could continue a miserable, brain-dead existence. This is an example of the necessity of having a Durable Power of Attorney for Health Care Decisions.
Probate

Bankruptcy
Before filing a business bankruptcy we will discuss numerous factors. One of the main considerations is whether the core business or farm is producing enough income to meet its overhead, overhead being necessary short-term expenses [current salaries, current utilities, current taxes, current reasonable rent (or mortgage payments) and the like]. For this analysis, we momentarily forget about the total debt (credit cards, lines of credit, taxes, pensions, mortgages, etc) and look instead at the core business. Basically, if the revenue from the core business is sufficient to pay overhead, including reasonable rent (or mortgage payments based on the fair market value of the right to occupy the premises), a chapter 11 or 12 is normally preferable to an outright liquidation.
