Criminal Defense

Sex Crimes
Sex offender registration is a serious and potentially life-altering consequence for those clients convicted of sex offenses. Rankin & Sultan strives to limit those consequences from the time of arrest through the Sex Offender Registry Board (SORB) hearing process and beyond. We have achieved substantial relief for many clients in this complex area, including restoration of hearing rights, reduction in classification level, removal from public dissemination, and complete relief from the obligation to register (on either jurisdictional or substantive grounds).
Fraud
The Department of Justice spent several years investigating our client for bankruptcy fraud. Although the local prosecutors were prepared to file an indictment, we succeeded in derailing the prosecution by obtaining review of the case by Department of Justice officials in Washington, D.C. No charges were ever brought.
Robbery
United States v Serrano-Acevedo and Diaz-Jimenez, 892 F.3d 454 (1st Cir. 2018)(reversing the defendant’s convictions for armed bank robbery and possession of a firearm during and in relation to a crime of violence holding that the warrantless search of his home did not fit within the protective sweep or voluntary consent exceptions under Fourth Amendment doctrine and that the admission of the evidence seized during the unconstitutional search was not harmless error)
White Collar Crimes
Attorney Charlie Rankin began practicing criminal law in 1980. He practices in both state and federal courts. Charlie’s practice focuses on representing clients in a diverse array of complex criminal matters, but he is best known for his work representing clients charged with white collar crimes, including health care fraud, Medicare and Medicaid fraud, computer or cybercrimes, financial fraud, telemarketing fraud, tax fraud, and public corruption. In recent years, he was successful in avoiding indictment for several clients who were the targets of criminal investigations. He recently won an acquittal for a client charged with fraud following a three-week long jury trial in federal court.
Misdemeanors
Rankin & Sultan’s criminal defense practice in the Massachusetts state courts runs the gamut from representation of clients charged with assault & battery, larceny, and other misdemeanors in District or Municipal Court to serious felonies in Superior Court, including drug crimes, firearms offenses, sex offenses, fraud charges, and murder. In federal court, we represent clients facing a broad array of charges, including fraud, political corruption, conspiracy, drug offenses, child pornography, and everything else covered by the increasingly-comprehensive federal criminal code. We are also called upon to represent clients in other states, joining forces with local counsel to create a powerful and effective criminal defense team.
Drug Crimes
Our client was charged with possession of marijuana with intent to distribute. We persuaded the trial court that the police had unlawfully stopped and searched our client, and that the marijuana had to be suppressed as the fruit of an unconstitutional search. Since the prosecution could not go forward without the marijuana as evidence, the case was dismissed and the defendant was discharged.
Assault
Our client, who had been convicted many years ago of indecent assault and battery, was initially classified as a Level One sex offender by the Sex Offender Registry Board. Following a hearing before SORB, he was entirely relieved of the obligation to register.
Murder
Many criminal cases are won or lost long before a jury is empaneled and the first prosecution witness testifies at trial. Motions to dismiss, motions to suppress, motions to sever counts or defendants, motions to exclude evidence, and a plethora of other potential substantive motions must be carefully considered. When such a motion may help our client by weakening the prosecution’s case and increasing our leverage to obtain a favorable result, we research, brief, and argue the motion before the trial court and, in some circumstances, before an appellate court as well. A successful motion may end the case altogether or seriously hamper the prosecution’s ability to present its case at trial. In a first degree murder case we tried in Suffolk Superior Court, a successful motion to suppress our client’s confession led to an acquittal at trial. In a drug case we litigated in Middlesex Superior Court, a successful motion to suppress the fruits of a search warrant of our client’s home resulted in the prosecution’s dropping all charges. Even where a motion to suppress or another substantive motion is denied by the trial court, that same motion may lead to the overturning of any subsequent conviction on appeal. The opportunity to weaken the prosecution’s case through effective motion practice should never be wasted.
Probation Violation
Individuals on probation in state court or on supervised release in federal court may be accused of violating the terms of their release and face revocation proceedings. The alleged violation may be as serious as new criminal charges or as minor as failing to appear for scheduled appointments or filing required reports. Significantly, the standard for finding such a violation is preponderance of the evidence, far lower than the beyond a reasonable doubt standard of proof required for a criminal conviction. Whatever the alleged violation, the stakes in these proceedings are quite high since the client faces potential incarceration.

Manslaughter
We began representing our client following his conviction of first degree murder. After succeeding in obtaining a reversal of his conviction on appeal, we negotiated an agreement with the District Attorney which resulted in his pleading guilty to manslaughter and serving a total of less than ten years in prison.
Prostitution
Our client, a female who had been convicted of an economically motivated prostitution-related offense, was classified as a Level One by the Sex Offender Registry Board (SORB) and sought to be relieved of the obligation to register. On appeal to the Supreme Judicial Court (SJC), we argued that the SORB arbitrarily and capriciously failed to consider the relevance of our client’s gender to the assessment of her risk of reoffense, and erred in denying her funds for an expert on female sex offenders. In a landmark decision, the SJC agreed, recognizing that the SORB guidelines were out of date and holding that it was an abuse of discretion for the SORB to refuse to consider recent and relevant scientific research merely because such research is not contemplated by the outdated SORB regulations. The SJC also broadened the scope of when expert funds should be authorized.

Student Visas
College and university disciplinary proceedings vary tremendously from school to school. Different schools have different policies regarding what evidence the accused can present, access to witnesses and information from the accuser, who is entitled to be present at a hearing, and even whether there is to be a hearing at all! Rankin & Sultan guides our clients through this complex and perilous thicket. At Rankin & Sultan, we approach college and university disciplinary proceedings much like a criminal case.
