I went to Mr. Derek Moses because he was recommended by a personal friend of mine. First... Verify what your friends say. I was having problems with the IRS and needed a CPA to assist with a 2003 audit and returns for 2004. Mr Moses boasted about his credentials. Columbia University Graduate, Certified financial planner and CPA!. Oh how I was impressed! I signed a power of attorney so that he could obtain my transcripts and have access to my troubles. Apparently, the IRS informed him that he was an "unenrolled preparer" and could not represent me before the IRS. I did not know.



He failed to disclose this revelation. He deliberately withheld this information. I did not have a check with me that day and took it a week later.He had ample opportunity to advise my of theses facts. I would not have written that check. I would have found someone else. A real CPA. After my troubles, then I started doing some checking. Not only is Mr,. Moses not a CPA, he has never been a CPA, he never passed the required examination!. He is not licensed in any state. I have sent him a certified letter to confirm our conversation on 11/19/2008. He has five business days to return my money. He has already informed me that he can do the work and that he will not be returning my money. He seems to think that two(2) phones calls to the IRS warrants $750!. I don't think so. I will be suing him in small claims court 11/26/2008. That will be the fifth business day.



This is not the only place I have file a complaint with Mr Moses. I have also filed a formal complaint with the Georgia State Board Dept of Accounting. They too have verified he is an unlicensed practitioner. He is not a CPA!!!. Certified Public Accountant and thus not recognized by the IRS!



My concerns with Mr. Moses are specific. He deliberately failed to disclose the significant information that he is not an "enrolled preparer".Lets surmide that he had forgotten his little problem of being an " unenrolled preparer", the IRS refreshed his memory on 10/28/2009. He was informed by the IRS, over the phone, that he could not represent me.He sat there and lied to me and told me he could help me with my problem after he was informed by Ms. C Hardman, IRS Agent in Appeals that he could not.. Now why didn't Ms. Hardman advise me? Well, I had signed the power of attorney and it was not her responsibility. I feel she could have asked to speak to me and could have told me that day. I was sitting right there. If I had known this, I would have been on my way. I certainly would not have come back with a check for $750!!! I guess she thought, " this is a dumb doctor"! I chose him to be my power of attorney so she spoke to him. I was not informed until I received a letter dated 11/19/2008. I immediately cancelled his power of attorney, found a legitimate CPA, signed a new power of attorney and my returns have been completed and submitted as I write this complaint!



The deliberate practice of failing to disclose vital information to a client is immediate grounds for termination of that business affiliation. If I ever tried to coerce a patient to allow a medical procedure by deliberately failing to disclose pertinent medical information, I would be sanctioned by the state licensing board. I could lose my license! Since he does not have license to sanction... he is not concerned! I shall reveal who I am so that no one else goes through what I am going through. First get your taxes done by legitimate professionals. Would you go to an unlicensed doctor??? No, you would not... do not go to an unlicensed accountant. If you do, be prepared to suffer. F.
